1. INTRODUCTION
These Terms of Service (“Terms”) govern your access to and use of the Not Sorry website, online store, products, services, and related services.
Not Sorry is a consumer brand and online store operated by DWOING, the registered business entity responsible for the operation of the Store and the sale and fulfilment of products.
By accessing the Store, browsing the website, creating an account, placing an order, or purchasing any product from us, you acknowledge that you have read, understood, and agree to be bound by these Terms, together with any other policies expressly incorporated into these Terms.
If you do not agree with these Terms, please do not use the Store or place an order.
2. DEFINITIONS
For the purposes of these Terms:
“DWOING,” “we,” “us,” or “our” means DWOING, the legal business entity operating the Store.
“Not Sorry,” “Store,” “Website,” or “Site” means the Not Sorry consumer brand and its online store operated by DWOING.
“Customer,” “you,” or “your” means any person who accesses the Store, places an order, or purchases products from us.
“Product” or “Products” means the phone cases and any other products made available for purchase through the Store.
“Order” means a purchase request submitted by a customer through the Store.
3. ELIGIBILITY TO USE THE STORE
By using the Store, you represent that:
- You are legally capable of entering into a binding agreement under applicable law.
- The information you provide to us is accurate and complete.
- You will use the Store only for lawful purposes.
- You will not use the Store in a manner that violates applicable law or the rights of others.
If you are purchasing on behalf of another person or entity, you confirm that you have the authority to do so.
4. ABOUT OUR PRODUCTS
Not Sorry primarily offers phone cases and related consumer products, including products that may be produced or fulfilled on a print-to-order / made-to-order basis.
Product images, colours, textures, dimensions, typography, and other visual representations are provided to help customers understand the product.
Actual colours or appearance may vary slightly depending on:
- Screen and display settings
- Lighting
- Photography
- Printing processes
- Material characteristics
- Manufacturing variations
Minor variations that do not materially affect the product's functionality or conformity with the order may occur as part of normal production.
We do not guarantee that the colour displayed on every device will exactly match the physical product.
5. PHONE MODEL AND PRODUCT SELECTION
The customer is responsible for selecting the correct phone model, variant, design, and other applicable product options before completing an order.
Customers should carefully verify their exact phone model before placing an order.
Different phone models may have different dimensions, camera layouts, button placements, and compatibility requirements.
If a customer selects the wrong phone model and we supply the product corresponding to the selection made in the order, the order will generally not qualify for a return or refund solely because the customer selected the wrong model.
If we send a product different from the model ordered, the matter will be handled under our Return & Refund Policy.
6. PRODUCT AVAILABILITY
All products are subject to availability.
Because certain products may be produced on demand, an item shown as available on the Store may still become temporarily unavailable because of:
- Production limitations
- Supplier or fulfilment issues
- Material shortages
- Technical errors
- Inventory or system errors
- Other circumstances beyond our reasonable control
If we cannot fulfil an accepted order, we will contact the customer and provide an appropriate resolution, which may include cancellation and refund where applicable.
7. ORDERS AND ORDER ACCEPTANCE
Placing an order through the Store constitutes an offer by the customer to purchase the selected product.
After you place an order, you may receive an order acknowledgement or confirmation.
An order confirmation does not necessarily mean that we have irrevocably accepted the order in every circumstance.
We reserve the right to review and, where reasonably necessary, refuse or cancel an order before fulfilment in circumstances including:
- Product unavailability
- Pricing or listing errors
- Payment issues
- Suspected fraud
- Incorrect customer information
- Shipping restrictions
- Technical errors
- Duplicate orders
- Abuse of promotions or discount codes
- Other legitimate operational or legal reasons
If we cancel an order after payment has been received, we will arrange an appropriate refund of eligible amounts through the applicable payment method, subject to applicable law.
8. ORDER INFORMATION
You are responsible for ensuring that all information submitted during checkout is accurate, including:
- Name
- Email address
- Phone number
- Billing information
- Shipping address
- PIN code
- Selected phone model
- Product variant
- Other information necessary to fulfil the order
We are not responsible for delays, failed deliveries, or additional costs resulting from incorrect or incomplete information supplied by the customer, subject to applicable law.
If you notice an error after placing an order, contact us as soon as possible.
We will try to correct an error where the order has not yet entered production or fulfilment, but we cannot guarantee that changes will be possible after processing has begun.
9. PRICING AND TAXES
Product prices displayed on the Store are the prices applicable to the relevant product at the time of purchase, subject to applicable taxes, charges, promotions, and checkout conditions.
Prices and product availability may be changed from time to time.
A price displayed incorrectly due to a technical, typographical, system, or other error may be corrected before fulfilment.
Where an order has already been accepted and paid for, any cancellation or corrective action arising from a material pricing error will be handled fairly and in accordance with applicable law.
Where applicable, taxes and other mandatory charges will be reflected in the checkout process or order documentation.
10. PAYMENT METHODS
We may provide one or more payment methods through third-party payment service providers.
Available payment methods may include:
- Credit cards
- Debit cards
- UPI
- Net banking
- Wallets
- Cash on Delivery (“COD”)
- Other payment methods made available at checkout
Payment methods may change from time to time.
Payment transactions are subject to the terms and security procedures of the relevant payment service provider.
We do not control the internal processing systems of third-party payment providers and are not responsible for delays caused solely by their systems, subject to applicable law.
11. CASH ON DELIVERY
Where COD is available for an order, the customer may be required to pay a COD service charge of INR 60 upfront at checkout.
The remaining eligible order amount is payable according to the COD instructions provided during checkout and delivery.
COD availability may depend on:
- Delivery location
- Product eligibility
- Order value
- Courier availability
- Serviceability
- Fraud or risk controls
- Other operational conditions
We reserve the right to restrict or disable COD for particular orders or locations where reasonably necessary.
An order placed using COD may be subject to additional verification before fulfilment.
Repeated refusal or non-acceptance of COD orders may result in COD being restricted or disabled for future orders, subject to applicable law.
12. ORDER CANCELLATION
Customers should contact us as soon as possible if they wish to cancel an order.
Because certain products may be produced on demand, cancellation may only be possible before the order enters production or fulfilment.
Once production, fulfilment, or shipping has begun, cancellation may no longer be possible.
Our Return & Refund Policy explains the cancellation and refund process in greater detail.
Nothing in this section limits any cancellation or other rights that cannot legally be excluded.
13. RETURNS AND REFUNDS
Returns and refunds are governed by our separate Return & Refund Policy, which forms part of these Terms.
Because certain products are produced on demand, ordinary change-of-mind returns are generally not accepted.
However, eligible claims involving products that are defective, damaged, incorrect, or materially different from what was ordered will be handled in accordance with our Return & Refund Policy and applicable law.
Nothing in these Terms removes or restricts mandatory consumer rights.
14. SHIPPING AND DELIVERY
Shipping and delivery are subject to our separate Shipping & Delivery Policy, which forms part of these Terms.
Delivery estimates are provided in good faith and may be affected by:
- Production time
- Courier delays
- Weather

- Incorrect addresses

Where applicable law provides a remedy for failure to deliver within a stated period, such rights will be respected.

Customers are responsible for providing a complete and accurate delivery address.
This may include:
- House/building number
- Street/locality
- City
- State
- PIN code
- Contact number
- Any other information required by the delivery provider
If delivery fails because of an incorrect or incomplete address, refusal to accept delivery, repeated failed delivery attempts, or other circumstances attributable to the customer, additional costs or other consequences may apply where permitted by law.
16. INTELLECTUAL PROPERTY
All intellectual property appearing on the Store, unless otherwise stated, belongs to or is licensed to DWOING or its relevant licensors.
This may include:

Purchasing a product does not transfer ownership of the underlying artwork, design, copyright, trademark, or other intellectual property to the customer.

If you create an account with the Store, you are responsible for maintaining the confidentiality of your account credentials.
You are responsible for activities carried out through your account unless the activity occurred without your authorization and you have notified us appropriately.
Please contact us promptly if you believe your account has been compromised.
We may suspend or terminate an account where reasonably necessary to protect the Store, our customers, or our systems, subject to applicable law.
20. THIRD-PARTY SERVICES
The Store may use third-party services, including:
- Shopify
- Payment gateways
- Courier and logistics providers
- Production and fulfilment partners
- Analytics services
- Marketing platforms
- Customer communication services
- Other technology providers
These third parties may have their own terms and privacy policies.
Your use of a third-party service may therefore also be subject to that provider's terms.
We are not responsible for the independent acts, omissions, policies, or systems of third-party providers except to the extent responsibility cannot legally be excluded.

Where we identify a material error, we may correct the information and, where appropriate, contact affected customers.
Nothing in this section limits statutory consumer rights concerning misleading or materially inaccurate product information.
23. PRODUCT USE AND CARE
Customers are responsible for using products appropriately and in accordance with their intended purpose.
Phone cases are designed to provide protection and style but should not be considered a guarantee against every type of damage to a phone.
We do not represent that a phone case will prevent damage from:
- All drops
- Extreme impact
- Crushing
- Water or liquid exposure
- Extreme temperatures
- Improper installation
- Misuse
- Other extraordinary conditions
Any specific protection claims will be based on the information provided on the relevant product page.
24. DISCLAIMER OF WARRANTIES
To the extent permitted by applicable law, the Store and its services are provided on an “as available” basis.
We do not provide warranties beyond those expressly stated on the relevant product page, product documentation, applicable law, or our written policies.
